Pa. Bureau of Workers Compensation Announces Standard for Prescription Drug Pricing in 2023

Under the Pennsylvania Workers’ Compensation Act, the Bureau of Workers’ Compensation, Department of Labor & Industry, annually determines the standard to be used by the Bureau for determining the reimbursement rate for prescription drugs dispensed to injured workers by pharmacies. For 2023, the Bureau has announced that, under 34 Pa. Code § 127.131(b) (relating to payments for prescription drugs and pharmaceuticals—generally), the Department of Labor and Industry, Bureau of Workers’ Compensation, gives notice that it utilizes the Merative Micromedex Red Book to determine the average wholesale price of prescription drugs. This applies to payments and fee review applications.
